(Reuters) - A judge concluded the investigation into one of Haiti's most notorious political assassinations on Friday, accusing nine people - including several close associates of former President Jean-Bertrand Aristide - of having a hand in the killing of radio journalist Jean Dominique.

Mirlande Libérus, a former senator from Aristide's political party, was indicted as the organizer of the double murder in April 2000 of Dominique, owner of Radio Haiti Inter, and a security guard, according to a summary of the judge's report made public by an Appeals Court panel on Friday.

The two victims were shot by unidentified gunmen as Dominique was driving into the radio station's offices in Port-au-Prince, according to the judges.

Evidence in the case indicated that Libérus had been given the directive by Aristide to silence the popular journalist and human rights activist, the report said, citing witnesses who testified before Judge Yvikel Dabrésil.

The judge did not indict Aristide as part of the conspiracy, apparently concluding that the evidence was insufficient.

"There is no basis - either in fact or law - for what this absurd judge did," said Ira Kurzban, a Miami-based former attorney for the Haitian government, who still represents Aristide in some matters.

"Neither Lavalas, nor any member of the party, had anything to do whatsoever in the death of Jean Dominique," he said, calling the judge's report politically motivated.

Dominique's widow, Michele Montas, welcomed news of the report, saying it was a "positive step" after many years of seeking justice.

"It's been 10 years since I gave my testimony in the case," Montas told Reuters.

Montas moved to New York after the killing and is a former spokeswoman for the United Nations Secretary General Ban Ki-Moon. She declined further comment, saying she has not seen a copy of the judge's report.

The judge's full report is due to be published in the coming weeks, after it has been formally accepted by the Appeals Court, according to Guyler Delva, secretary-general of the Haitian press freedom watchdog group, SOS Journalistes, who chairs a committee overseeing cases of journalists killed in Haiti.

"It's very encouraging," said Delva, a former Reuters correspondent who now runs the website Haitian-Caribbean News Network (HCNN). He said it was unclear why Aristide had not been indicted. "How could you indict Libérus for receiving the order to get rid of Dominique, and not the person who gave the order," he said.

The nine accused include Senator Libérus and Harold Severe, former deputy mayor of Port-au-Prince. The others are Annette Auguste, Franco Camille, Merité Milien, Dimsley Milien, Toussaint Mercidieu, Jeudi Jean Daniel and Markington Michel. Several of them, including Severe, were previously arrested in the case but either were released and escaped from prison.

None of the accused has so far been arrested. Some live abroad, including Libérus, who is believed to be in Miami.

Due to its political sensitivity, the case has taken years to prosecute and slipped through the hands of numerous judges, one of whom fled the country.

Seven judges in all have worked on the case over a span of nearly 14 years. If and when a trial will be held remains unclear as the case could still be appealed to the Supreme Court.

An agronomist by training, Dominique was born into Haiti's light-skinned mulatto elite, but broke ranks to become a champion of the country's poor.

The story of his life - and death - was made into an award-winning documentary, "The Agronomist," by filmmaker Jonathan Demme, director of "The Silence of the Lambs."

Dominique, wearing his trademark black leather cap, revolutionized Haitian broadcasting by addressing his audience in native Creole, rather than French, and denouncing abuses by those in power.

His scathing on-air editorials made him an enemy of Haiti's dictators, Francois "Papa Doc" Duvalier and his son Jean-Claude "Baby Doc."

Dominique later spoke out against Aristide's political party, Lavalas, accusing it of corruption and abuse of power, and was widely considered as a rival to Aristide's bid to return to power in 2001.

Translation of last commentary by Jean Dominique on March 27, 2000

"In the light of the concept of free, transparent, democratic and honest
elections, this should be the duty of of impartial observers? However, Mr.
Leopold Berlanger, the Coordinator of the Conseil National d'Observateurs
(CNO), is part of a coalition, working through Vision 2000, which is engaged
in the destruction of Lavalas. First Point.

Second point. The Senator Wesner Emmanuel at this microphone and publicly,
assuming his responsibility as a functioning senator, pointed out that Mr.
Leopold Berlanger (who at that time had no credentials or title relating to
the election process) during the December 16, 1990 presidential elections
convinced a computer operator to change the results of the senatorial
elections for the West. Senator Wesner Emmanuel further stated that he has a
taped recording of this conversation between the employee and Berlanger and
when this employee told Senator Wesner Emmanuel that the results of the
elections are not the ones being announced by the President of the
Departmental Electoral Bureau, Senator Emmanuel replied that he has a tape of
the conversation with Berlanger and that he would publicize this trickery on
the air. The employee considered this and then retreated and said that the
results are correct and then gave the original results.

Voila, so this individual is now a member of a coalition which for five years
has worked virulently with Vision 2000 against the Lavalas movement and this
same person is the head of a national commission to observe the elections
while in 1990 he tried to manipulate the results, and this is the person
President Leon Manus gave the power to receive all information and documents
related to the electoral process that should be sent to him quickly: First
point.

Second point, to have the monopoly of the electoral observers: that all the
national observers accredited by the CEP to observe the elections must be
recommended by the CNO. Total monopoly! This is the second point.

Third point, which is more critical. In the case whereh is no original or a
duplicate available the observer from the CNO can put together a report of
the balloting as he observed it. This report which contains the numbers
written out would be signed by the members of the head of the electoral
bureau and the observer from the CNO. So, here is Mr. Berlanger having the
power to put together the written report of the results of the vote.

Meanwhile, the electoral law is clear in Article 158: the written process of
the balloting is drawn and signed by the members of the electoral bureau and
in some cases by the representative of the party, groups, or political groups
who are officially recognized, or cartels or candidates. The written report
is prepared in at least six formally signed originals. If the representative
of a party, group, or political party, officially recognized, or cartels or
candidates refuse to sign the report, they will state the reason invoked or
alleged for their refusal to sign and these protestations have no immediate
value, and are only for future reference. The refusal to sign a report by
the representative of the electoral bureau has no effect on the validity of
the electoral operations.

The word observer never appears in Article 158. Never!

Article 159: An original of the written report of the balloting is attached
to the door of the electoral bureau by the president of the bureau and the
other originals are distributed as follows: one to the BEC, two to the BED
which transmits one to the CEP, two others go to the two representatives of
the candidates that obtained the largest number of votes.

There is no mention in the electoral law of an original written report or a
copy to be given to an observers named by Berlanger . No mention whatsoever.
The question we are posing now before further analyzing this text, which is
unbelievable, is the following: Is President Manus, the president of the
CEP, qualified to sign an agreement which contradicts the text and the spirit
of the electoral law?

We have noted in the course of the electoral process, with the passion that
you all know we have, the legitimate suspicion that there is a threat to the
process with the successive unpleasant revelations of the role of IFES inside
of the CEP and financed and directly manipulated by USAID. So, these
legitimate suspicions about the CEP are getting larger by that unbelievable
accord with the CNO. The question we are asking is the following: Did
President Manus sign this very important text to give Mr. Leopold Berlanger
the possibility of altering the results of the vote? Is President Manus'
signature in accord with the other eight members of the CEP? I already know
that one of them doesn't even know about the accord.

Secondly, Berlanger, who is the Coordinator General of the CNO, did he check
with the CNO to sign , negotiate and sign the text? Thirdly, it is written in
this agreement that all the documents should be directed to the executive.
Did they send this protocole d'accord to the Executive? I direct this
question to the President of the Republic."

Thus, only days before he was silenced Jean Do was exposing machinations against Aristide's party, Lavalas. So, it makes absolutely no sense that Aristide would have wantrf to harm one of his best and most powerful allies, at a time when he knew full well that his real enemies in Washington were busy developing strategies to stop his return to power.

The idea that Jean Dominique was a potential political opponent to Aristide is simply RIDICULOUS! And to this day his spouse Michelle Montas will tell anyone that there was never any truth to the idea that Jean Do was planning to run for office. Perhaps, the laboratory was circulating this rumour to foment their own situation. But, it still made no sense given the timing of Dominique's murder.

Let's say he was contemplating running for office....yet as late as March 27, 2000 he is hard at work denouncing machinations he suspects USAID and the Macoutes are undertaking to steal the election FROM LAVALAS!?

The May 2000 Senatorial elections where only a few weeks away.....and Dominique had not given any hint of his interest to run for office.

And, everyone knew that Aristide was unbeatable, having been kept away (1995-2000) because the foreign powers who brokered the rotten deal for his 1994 return insisted that the Haitian people accepts the 3 years he spent in exile as part of a "full first term" and still for him to accept staying away from office for at least a full term before running for office....

Haitians knew it was a rotten deal enforced by might not right....so, it was logical and predictable that at the next possible opportunity to elect Aristide, only a fool could imagine being able to beat him at the polls. And Jean Dominique, by all accounts, was a very smart man. Also, there was NEVER any indication on his part that he cared about running for office. This idea is plain stupid, farfetched and made-up to cover what is more realistic.

Pressure on the judge became very heavy. The Senate president, Yvon Neptune, said that "an insignificant little judge" could not summon a member of the Senate, whose members threatened to "investigate the precise reasons" for the judge wanting to talk to Toussaint. An associate of Sen. Prince Pierre Sonson said he had been threatened after Sonson called on Toussaint to go before the judge.
