Illegal, racist and discriminatory Pennysaver (Rockland NY) and Interim Healthcare, Inc. October 15, 2015 employment advertisement targeting Haitians in violation of U.S. and NY state equal protection and labor laws.

On October 15, 2015 Pennysaver advertisement placed by an outfit called Interim Healthcare Inc. (see ad below) for a "Female LPN/RN needed at West Haverstraw" The employment advertisement details that Interim Healthcare Inc is looking for a "Laid back nurse, no haitians, must have strong respiratory mngt, gtube. No track. Direct deposit. Weekly paychecks. Must have NYS certificate. Please complete the application www.careersbywebcom and select Nanuet as the city. Or call 845-425-2655 as for Nataliya or Annie. Mon-Fri between 9am-4pm only." Yeah, you read right. smh. It says, blatantly "no haitians." Not even bothering to capitalize the "h". A duly outraged Haitian posted the ad on the Free Haiti Movement. So, come on Ezili Network I am asking everyone to make some phone calls, write some emails bright and early tomorrow morning, write some emails. cc: HLLN at erzilidanto@yahoo.com. We already have folks who called over this weekend.
This employment advertisement is not legal. Interim Healthcare Inc and Pennysaver show a callous disregard for the law, one by placing this advertisement in the public domain, the other by publishing it in their newspaper. Is this a pattern of behavior or just an isolated incident? An official government investigation is required by the necessary authorities charged with administering the applicable NY State and EEOC discrimination laws or even the hate laws perhaps? HLLN would like concerned individuals, especially Haitians, to call, write, express your outrage and discontent as well as to send this advertisement to:

There are Federal and State laws violated even if this ad is an error. It has caused public harm to a targeted group on the basis on race/nationality (not to mention gender! which is illegal). There's an administration proceeding for such cases/ EEOC case violations, government rule for Medical licenses for such agencies....employment agency licenses possibly compromised also?

ROCKLAND COUNTY, N.Y. – A national health care company is under fire after posting an ad in Rockland County specifically requesting “no Haitians” apply for the position.
New York Senator David Carlucci called out the company via Twitter Sunday afternoon.

The Interim HealthCare ad, which was posted in the New City Pennysaver, was looking for a “Female LPN/RN” in West Havernstraw who would be a “laidback nurse” and stated “no haitians” (sic) could apply.
Carlucci, who oversees Rockland County and parts of Westchester County, vowed to call on the NY State Department of Labor and federal Equal Opportunity Employment Commission to conduct a full investigation.
He said he stands with those who are outraged by the ad.
Interim HealthCare is one of the oldest leading home care and medical staffing companies, according to its website. It has more than 300 locations nationwide with approximately 75,000 health care workers.
Interim apologized on its Facebook page, saying that the ad is “totally unacceptable and is offensive to us.” The company vows to make sure it will never happen again.
Pennysaver did not comment.

Haïti - FLASH : Une annonce d'emploi anti-haïtien soulève l’indignation au Congrès Suite à la publication d’une annonce d’emploi, dans le New City Pennysaver (USA), qui exclus spécifiquement les personnes d’origine haïtienne, la Congresswoman Yvette D. Clarke a publié une déclaration condamnant vigoureusement une telle annonce discriminatoire.
Déclaration d’Yvette D. Clarke :
« La soumission d'une annonce d'emploi, qui exclut les personnes d’origine ethnique et la publication d'une telle publicité, est immorale et inacceptable et une violation des lois de l'État et fédérales, qui interdisent la discrimination à l'embauche.
Cette annonce d'emploi rappelle une forme de discrimination qui était autrefois une pratique courante aux États-Unis et devrait nous rappeler, que la discrimination à l'embauche - explicite ou implicite - reste un problème grave qui continue à saper les occasions pour de nombreux américains qui sont qualifiés, d'entrer dans un emploi ou une profession particulière, et qui ne peuvent pas trouver du travail.
Je demande instamment une enquête complète sur cet incident par le Département d'État du Travail de New York, la Commission de l'égalité des chances en matière d'emploi et le Département de la Justice afin de déterminer la raison pour laquelle cette offre d'emploi a été soumise et publiée et la poursuite des personnes qui sont responsables à la pleine mesure de la loi. »

Il n'y a pas d'erreur, cette agence va s'en tirer avec une tape sur la main. Meme une amende importante ne peut la forcer a ne pas discriminer. Il revient aux Haitiens d'etre de meilleurs travailleurs et de se diversifier comme main d'oeuvre. Quand votre nombre est grand, vous vous federez, vous meritez de vous organiser, de fonder votre propre agence et de vous syndiquer a la rigueur. Malheureusement, les Haitiens ne pensent qu'a s'enrichir vite comme en politique aux depens de leur prochain. Si votre employeur haitien est un escroc, il est preferable de vendre vos services a un raciste qui respecte la loi.
Il fut un temps ou je me rendais chaque semaine a Montreal par train ou par bus. J'etais souvent frustre et vexe que des chauffeurs de taxis haitiens roulaient trop lentement ou prenaient un chemin «tordu» alors que les chauffeurs quebecois etaient plus courtois et plus professionnels. Mais un jour, un conflit s'eclata apres maintes plaintes des clients quebecois contre les chauffeurs haitiens deja accuses de voleurs de jobs car le taxi etait le gagne-pain d'un grand nombre de Quebecois deja. Les Haitiens etaient maltraites comme dans le cas present et cela a souleve des protestations mais il y a peu qu'un gouvernement peut-faire dans de tels cas.
Finalement, les Haitiens allaient compter sur un investisseur plus ou moins recommandable du nom de Roger Lafontant pour acheter leur propre permis d'operer une compagnie de taxis.
C'est pourquoi je ne monte pas sur mes grands chevaux en apprenant ces nouvelles surtout qu'on aurait pu se passer de cette discrimination en etant pratique et avec un peu de savoir-faire.
Que les Haitiens forment leurs propres agences s'ils sont competents et fiables. C'est le meilleur moyen de combattre la discrimination si vous choisissez en grand nombre de faire ce genre de travail.
Les chauffeurs haitiens sont plus professionnels. Il reste surement des mauvais mais la majorite d'entre eux savent qu'il est de leur devoir de proteger l'image de la compagnie.
