· U.S. citizens are increasingly becoming targets of crimes ranging from carjackings to robberies. An atmosphere of perceived impunity has encouraged criminals to move from troubled neighborhoods to those once considered safe. Several brazen carjackings have occurred in broad daylight and many robberies have been committed in recent months. In October 2000, the U.S. Embassy in Port-au-Prince reported the attempted carjacking of one of their vehicles. The driver of the Embassy van radioed for assistance and was able to escape unharmed. Carjackings are becoming increasingly frequent in the capital city of Port-au-Prince, with vans and 4-wheel drive vehicles being the most common targets.

Kidnapping/Extortion/Organized Crime/Corruption

· Kidnappings are becoming more common in Haiti. A report released in January 2002 showed that ten abductions were reported in Port-au-Prince in one seven-day period that month. During the few months prior to that, seven U.S. citizens were also kidnapped. The number of actual cases is expected to be considerably higher, as most of the victims’ families opt not to contact the police. Some estimates indicate that there has been an average of one abduction per day since November 2001. The Haitian National Police have arrested 15 suspects in connection to the various kidnappings. In April 2001, a U.S. businessman was kidnapped from his home in Port-au-Prince. The victim, who was the owner of a Toyota dealership and the son of a former U.S. diplomat, escaped just hours after his capture, unharmed.

· Travelers should be particularly alert while in the Port-au-Prince airport. Criminals tend to scope out arriving passengers for later assaults, robberies, and kidnappings. They also survey bank customers and subsequently attack them. Police are of little help to victims, as they are poorly equipped and are not able to respond in a timely manner.

· Organized criminal activity and gangs in the Port-au-Prince area are also on the rise. The high unemployment rate, declining economic conditions, growing popular dissatisfaction in poor neighborhoods, such as Cite Soleil, and increased international narcotics trafficking have led to an increase in organized criminal activity. In the past gangs have been reluctant to engage the Haitian National Police in gun battles ; however, this seems to be changing.

· The transshipment of cocaine from Columbia poses a major problem in Haiti, and is partially responsible for the rise in crime. A lack of stable government coupled with poorly paid civil servants make manipulation by drug traffickers a course of business at sea and airports. Other social problems and poverty concerns take priority over combating the drug trafficking problem. The U.S. Coast Guard has assisted the government of Haiti in decreasing the flow of drugs by cooperation and training of police and customs’ officials. Conflict resolution is slow and may go against foreign firms if business dealings should cross organized crime of any form. Foreign firms looking to do business in Haiti should consider conducting a due diligence investigation on any potential business partners.

· Corruption is deeply embedded in South American, Central American, and Caribbean culture, and Haiti is no exception. Although Transparency International does not rate the country on its Corruption Perceptions Index, Haiti would likely have a very low rating on a scale of 1 to 10 (1 being the most corrupt). Despite the fact that corruption can be found in all levels of government, from the federal system to the local police force, it is generally not a problem that affects travelers to the country.

Police Response

· The Haitian police department and emergency services are considered unreliable and sometimes even unresponsive. Haitian citizens have little faith in what they believe to be a corrupt police force, which is the reason for many recent demonstrations. Policemen are frequently accused of killing innocent citizens. Police, fire, and medical assistance in Port-au-Prince can be telephoned using the emergency number 114, which is similar to the U.S. 911 emergency system.

CASES OF « ZERO TOLERANCE » CELLS

During a visit to the General Direction of the Haitian National Police on 28 June 2001, President Jean Bertrand ARISTIDE launched the "operation zero tolerance" campaign under the pretext of the fight against insecurity. This was the beginning of an agenda of murder, or tolerated murder - the open door for extrajudicial executions. The phenomenon of attachés resurfaced with creation of such groups with names such as Brigade spéciale (BS), Zéro Tolérance, Pèdi pa Chache, 5e Kolòn, Zobop, Palmantè Lanmò. These groups worked in collaboration with police officers under the direction of high level officials within the police. Below are noted some of the most shocking cases:

Port-au-Prince Police Station

In the two (2) months following the launch of "zero tolerance", the police station of Port-au-Prince executed at least fifty (50) individuals, according to the declaration of an officer [from the 3rd promotion] stationed at this precinct and published in the French newspaper « Le Monde » in December 2001.

On 16 September 2002, officers from this police precinct, under the direction of Commissioner Ralph Renaud Dominique, arrested in broad daylight Félix BIEN AIMÉ (alias Gwo Fefe), Paul Musac JEAN, and Dial NORMIL. The three (3) have been missing since.

On 5 December 2003, Police Commissioner Ricardo ETIENNE provided the leadership for a team of police officers and chimères that besieged the premises of the Faculté des Sciences Humaines (FASCH) and the Institut National d'Administration, de Gestion et des Hautes Etudes Internationales (INAGHEI). More than twenty (20) were injured in the attack, including the Chief Administrative Officer and Vice-Administrative Officer, Pierre Marie PAQUIOT and Wilson LALEAU, respectively, in addition to considerable material damages.

Placing offending officers at the disposition of the courts would be a clear indication of the new PNH leadership's will to purify the policing institution.

Carrefour Police Station

Under the direction of Commissioner Josaphat CIVIL, the precinct of Carrefour was given the distressing reputation of being a place of torture and summary executions.

On 26 October 2002, Emmanuel AUGUSTE, a former soccer player of the Black Eagles, was reported missing after having been arrested and taken to the Carrefour police station.

During the night of 7/8 December 2002, three (3) sons of Viola ROBERT were murdered. According to an [internal] police report dated 20 December 2002, the murderers of Andy PHILIPPE (20 years-old), Vladimir SANON (21 years-old) and Angelo PHILIPPE (22 years-old) are:


- Josaphat CIVIL : Police Commissioner
- Ménard MÉDAT : Officer level 4
- Pierrot GIVENS : Officer level 2
- Pierre AUGUSTIN : Officer level 2

To date, the direction of the judicial police has refused to execute the warrants issued against these officers, thus blocking the conclusion of the open investigation into this case and the prosecution of those responsible for this heinous crime.

It is the role of the General Direction to take all necessary measures to ensure that these warrants are executed, and in doing so signal concrete change in direction and leadership of the PNH.

Delmas 33 Police Station

The police precinct of Delmas 33, under the direction of Commissioners Camille MARCELLUS and Emmanuel MOMPREMIER, has become famous for its systematic human rights violations. Places such as Adoquin (Delmas 33), Habitation Vorbes (Petite Place Cazeau), and Route Bâtimat (connecting Airport Road to Cité Soleil) are used as slaughterhouses. The most infamous attaché of this police station responds to the name Jean-Anthony RENÉ (alias Grenn Sonnen).

On 4 October 2003 university student Nesly NUMA was arrested and driven to the Delmas 33 precinct where he was then tortured. He was accused of participating in the anti-government movement of his fellow university students.

It is the responsibility of the General Direction to put an end to the use of torture chambers at Delmas 33, to take disciplinary action against officers and attachés implicated in various crimes and infractions committed within the precinct, and to facilitate the work of the judiciary to bring forth the truth in these matters.

SHOCKING MURDER CASES

Numerous officers are accused of involvement in sensational acts of murder and massacre, but yet are not being legally pursued. One can cite the following as examples:

Case of Commissioner Negupe SIMON

On 22 October 2003, Commissioner Negupe SIMON ruthlessly killed Mrs. Fernande Jean, 24 years old and three (3) months pregnant. It is reported that during a dispute with her husband, Mrs. Jean threw a rock which incidentally missed its target and hit the Commissioner's vehicle. The Commissioner responded by shooting her several times in the head. How can one explain that the officer has never been rendered to the mercy of the courts, when he in fact publicly acknowledged his actions?

Case of Commissioner Harold ADÉCLAT

Police Commissioner Harold ADÉCLAT has been publicly denounced for his participation in the vicious murder of Amiot MÉTAYER. Despite the grave and persistent accusations against him, Harold ADÉCLAT was promoted to Logistics Director at the General Direction of the PNH. There has been neither an administrative investigation nor a judicial follow up for a situation that requires clarification.

Case of Inspector Principal Jean Marie DOMINIQUE

Office Jean Marie DOMINIQUE, then an Agent 4, is accused by the public of having coldheartedly killed Ronald FRANÇOIS, a member of the "Mouvman Revendikatif Ayisyen pou Devlopman ak Demokrasi" (MORAD), on 8 September 2001. The officer was later promoted to the level of Inspector and was transferred to Petit-Goâve. To date, he has never been called to defend himself against these accusations.

Case of Commissioner Yvens DÉCIMÉ

On 24 October 2003 Odoniel ESTORVIL, esquire, was arrested by a police patrol in Petit-Goâve on charges of stealing a suitcase containing fifteen thousand gourdes (Gdes15,000), He was violently beaten within the Petit Goâve police station and later transferred to the University State Hospital (HUEH) in Port-au-Prince, where he later died as a result of his injuries. Commissioner Décime, in charge of the precinct in question, still has not provided any explanation regarding the incident nor has responsibility for this death been fixed.

Case of Commissioner Frantz ELBÉ

This Commissioner is accused of having killed the young Stanley RODNEY in Grand Goâve during an anti-governmental demonstration on 29 January 2004. He is also accused of having arrested, in cooperation with attaché Jean-Anthony RENÉ (alias Grenn Sonnen), three (3) other young men from Grand Goâve - Pierre Jabin BELLERICE, Jean Bed BELLERICE and Luxon AUBIN - on Delmas 24 at approximately eleven o'clock in the morning of 21 February 2004. These three (3) had taken refuge in the metropolitan zone [following recent events in Grand Goâve]. Held at the Delmas 33 precinct, these three (3) young men have been reported missing since. To date, no investigation has been conducted to connect the responsibility of this commissioner with these reprehensible acts.

Case of Commissioner Camille MARCELLUS

While at the Delmas 33 precinct, Commissioner Camille MARCELLUS is the principal person responsible for the implementation of a « zero tolerance » cell responsible for a number of summary executions and acts of torture within the [Delmas] district as well as Cité Soleil.

It is this same Commissioner Marcellus who has been given the responsibility for the massacre that took place in Jubilé (Gonaïves) on 2 October 2003 when blind terror was unleashed indiscriminately against unarmed men, women, and children. For more than three (3) hours Jubilé was a living hell.

The Jubilé massacre was planned down to the minute. Less than twenty-four (24) hours before the police intervention, Departmental Police Director, Commissioner Camille MARCELLUS, made arrangements to have Mr. Aslès SAINT LOUIS - his former ally of the Delmas "zéro tolérance cell" - installed as State Prosecutor of the town's First Instance Court. Mr. Saint Louis, who does not possess the legal qualifications to hold such a position, was part of a plan of terror designed to provide legal cover for the questionable actions of police officers and to ensure their impunity. Commissioner Marcellus must be put before an investigative commission.

Case of Commissioner Chily CHARLES

Former member of the Unité de la Sécurité Présidentielle (USP) and former Director of the North Department Police force, Chily CHARLES is accused of participating in acts of repression carried out in Cap-Haitian since April 2003. His brutal intervention in the area of Zone V Chada II on 14 June 2003, left one (1) dead and three (3) severely injured, among them men who were merely playing cards or dominos.

Furthermore, he was publicly denounced for his involvement in the murder of his predecessor, Edner JEANTY, on Saturday 10 January 2004. While heavily armed men provided security outside, Inspector-General Edner JEANTY was tortured to death in a house belonging to the Léveillé family in the area of Monbin Lataye.

The autopsy report prepared by Doctor Rodrigue DARANG only revealed gunshot wounds to the body, in contradiction to the official version supported by images shown on Haitian National Television. Commissioner Chily CHARLES has never been the object of an investigation.

KIDNAPPING CASES

Cases of kidnappings distinctively rose in Haiti since the February 2001 return of former President Jean Bertrand ARISTIDE. The popular technique displayed an agenda put in place by the National Palace to extort money from citizens with means. Several officers are suspected of participating in a number of kidnappings reported. Former Chief Inspector-General of the Police, Harvel Victor JEAN-BAPTISTE, said himself, in a press conference that « all the armed gangs operating throughout the country are led by police officers ». Mr. Jean-Baptiste wanted to show the difficulty in combating the phenomenon of insecurity under these conditions.

Furthermore, in October 2002, Senator Dany TOUSSAINT, a former interim Police Director, denounced the implication of Inspector-General Jean Robert ESTHER in a kidnapping case. The Supreme Council of the Haitian National Police (CSPN) immediately assembled the Senate to look into this question. A closed meeting was organized by Lavalas Senators and the affaire was classified as if nothing ever happened. The public was never informed and suspicions remain. Thus it is time, now more than ever, to open an investigation into this affaire for the purposes of clarification.

CASES OF THEFT, CORRUPTION, PILLAGING AND SABOTAGE

The Haitian National Police is overflowing with police officers implicated in acts of theft, corruption, pillaging, sabotage and trafficking of illegal substances. Following the resignation and exile of former President Jean Bertrand ARISTIDE, certain officers were found leading groups of looters (groups de « déchouqueurs), organizing the pillage of certain public and private institutions. The General Direction of the National Police, the General Inspection, the private home of the former President, the sub-precinct of Varreux, and certain commerce establishments were looted by police officers, who were clearly identified by people in the neighborhood. An example must be set. Specific cases demonstrating such practices are noted below:

Case of Officer Laurore MALARE, agent 4

On Wednesday 3 March 2004, Laurore MALARÉ, an officer level 4 stationed at the sub-precinct of Delmas 3, stole a vehicle, license plate number SE-3812 which belonged to the Service Production department of the Haitian Electricity Company.

Case of Commissioner Negupe SIMON

The name of Negupe SIMON appears often in cases of armed robbery, torture and disappearance.

On 30 June 2003, at approximately two (2) pm in the area of Bois-verna, the residential area of Hinche, four (4) black-clad police officers on board Commissioner SIMON's service vehicle requisitioned the vehicle of Jocelyn DOMINIQUE, a well-known teacher at the Lycée Dumarsais Estimé in Hinche, as well as in other high schools in the city. This « seizure » did not respect any legal norms. The vehicle, with the following details, has not been involved in any crime or any breach of the law:

Serial number: J.A.4MR5HOXJOO3620

Volume: 3600 cc

Color: white

Year: 1998

License number: W 3001

It is important to note that the owner of the said vehicle is not the object of any judicial decision ordering the requisition of his goods. He was simply accused of driving a car that does not correspond with his social status as a teacher. The vehicle was taken to the police station of Hinche, from where it was last seen on Wednesday 2 July 2003. The owner's efforts to retrieve the vehicle via a judicial way have been in vain.

On 24 May 2002, a white Daihatsu truck with license number LT 0659 (Dominican Republic), was seized by the traffic police of Hinche as the registration documents showed some irregularities.

On 26 May 2002, the traffic police sent a detailed report as well as the keys and documents of the said vehicle to the State Prosecutor of the First Instance Court of Hinche. The latter decided to start an investigation and asked Commissioner SIMON to keep the vehicle, awaiting judicial instructions. On Wednesday 24 July 2002 Commissioner Negupe SIMON delivered the same vehicle to unknown individuals from Port-au-Prince. The keys and the registration documents are still being held at the clerk's office of the Court of Hinche, and Commissioner SIMON can still not answer any questions (which have been asked repeatedly by the Judiciary) pertaining to the vehicle's whereabouts.

Case of Commissioner Shiller LOUIDOR

Commissioner Schiller LOUIDOR, implicated in the scandal of embezzling seven hundred thousand dollars (US$700,000) to the Central Direction of the Judiciary Police (DCPJ). Commissioner Louidor was simply transferred to the Secretary of State Justice responsible for Public Security (SEJ) and has never been asked to explain the controversy surrounding him.

Case of Police Officers of USP andUSGPN

Fritz INNOCENT (alias Fritzner Noncent), Barthélemy VILBRUN Jr. (both officers of the Unité de la Sécurité Présidentielle (USP) ) and Patrick TISSELIN (USGPN) are implicated in the acts of sabotage of radio and television equipment in Boutilliers on 13 January 2004. The General Inspection has never decided to open an investigation into this matter.

CASES OF UNCONVENTIONAL PROMOTIONS

Management of the National Police personnel over the past three (3) years has been catastrophic. The institution is not only characterized by a complete lack of disciplinary rigueur, but a total contempt for the rules and regulations of the institution. The PNH functions without any career plan for its officers, and promotions have been awarded based on one's militancy and/or allegiance to the political power in place. The questions of merit or competency are not considered by those making the decisions. Former Director-General Jean Robert FAVEUR strongly highlighted this point. The time has come for the correction of this chaos for the ultimate good of the policing institution.

THE PROBLEM OF TRAINING WITHIN THE PNH

The widespread implication of police officers in acts of pillaging, theft, corruption, sabotage and the trafficking of illegal drugs is proof that our officers are poorly trained. They are neither prepared physically or mentally. The construction of a police force on solid foundations was the least of the worries of the former police leaders. And here are the results because of that:


- delinquents associated with the ruling power were integrated into the ranks of the Police without any theoretical or practical police training;


- the National Police Academy (ANP) for training police officers and the National Police School (ENP), as provided for by the law of 29 November 1994 in support of the creation, organization and functioning of the National Police, were never created. One has had to make due, each time, with the hasty training of groups of young people recruited on the basis of doubtful criteria;


- specific Police departments for sea, air, border areas, navigation, forests and other important administrative police domains (as provided for by the law) have still not been created after nine (9) years of the PNH's existence.

Mr. Director-General,

The Haitian National Police (PNH) is in the process of being raised from the ashes and it is imperative that it survives this crisis. Nothing should be overlooked to assure that this new beginning is met with success. The life of a public security force, as that of all state and non-state institutions, should not be measured by the life of one individual or group of individuals.

The new leadership team of the PNH must send a clear and unambiguous sign showing that it is at the height of its historic mission and that it is only guided by national interest. It is with this hope that NCHR makes the following recommendations:


- Pass on instructions to the Central Direction of the Judiciary Police (DCPJ) pertaining to the immediate execution of warrants issued against officers implicated in criminal activity, such as the assassins of Viola Robert's three (3) sons;


- Pass on instructions to the General Inspection of the Haitian National Police pertaining to investigations to be carried out concerning the serious cases of theft, kidnapping, pillaging, sabotage, murder and torture highlighted within this report, with intentions of rendering public the investigative results;


- Put an end to the use of torture chambers in police stations, in particular the Delmas 33 and Port-au-Prince precincts;


- Put an end to the usage of attachés;


- Rendering before the courts of officers guilty of committing crimes and/or infractions;


- Inform the population as to the actual numbers within the police force;


- Take the necessary measures to open as soon as possible the National Police Academy (ANP) and the National Police School (ENP);


- Take the measures necessary to recruit and train new police officers and officials, assuring that recruitment is based on rational criteria and that physical, theoretical and mental training is of an acceptable quality;


- Seriously envision an extensive training plan for police officers that coincides with the opening of two (2) or three (3) training centers in the provinces (in departments such as the Artibonite and the North, for example), in addition to Port-au-Prince;


- Make an appeal to competent Haitians as far as public security is concerned, to alleviate the current challenges on a short term basis;


- Embark on an immediate disarmament campaign;


- Establish an independent commission charged with examining the cases of members of the armed forces in the North, with the goal of separating those with reputations as human rights violators, drug traffickers or participants in the trafficking of contraband;

Bring before justice all such members known to be responsible for committing criminal acts. In so filtering the Front, selected members of could be entrusted to leadership of training schools of the Haitian National Police for the purposes of gauging their competence for participating in the police force, assuring (when necessary) an accelerated training in public security, and creating a special unit within the PNH to alleviate the serious problem of an insufficient amount of police officers. Such a decision could raise discontentment among several actors implicated in the crisis. However, it must be courageously considered in the superior interests of the Nation;


- Take all possible measures to return to the various detentions centers the more than three thousand (3,000) prisoners that are on the loose today as a result of the political troubles that succeeded in overthrowing dictator Jean Bertrand ARISTIDE.

The PPF includes the National Border Service, National Police, National Maritime Service, Judicial and Technical Police (PTJ) for investigatory activities, National Air Service, and an armed Institutional Protection Service or SPI for protection of public buildings. The PPF is also capable of performing limited military duties.

In contrast to the former PDF, the Panamanian Public Forces is on public record and under control of the executive.

In November 2008, the Servicio Aéreo Nacional (National Air Service) merged with its maritime counterpart, the Servicio Maritimo Nacional (National Maritime Service) to become the Servicio Nacional Aeronaval (National Aeronaval Service), also the creation of the new Servicio Nacional de Fronteras (National Borders Service) as an independent force from the National Police.

Estimating the costs of crime serves many purposes. At a very basic level, such estimates indicate the burden of crime for individuals and society. Victims often lose or have their property damaged. Replacing or repairing damaged goods, even in an era of widespread insurance, can result in substantial monetary loss. Victims also often sustain physical injury and suffer considerable psychological trauma. In seeking treatment or counseling, not to mention days lost from work, decreased productivity, and even long-term financial distress, victims of crime often experience a diminished quality of life and substantial financial burden. As the myriad consequences of crime are diverse and varied, estimates of monetary costs provide a common, easily interpretable measure for understanding the impact of crime on individuals and society.

Estimates of monetary costs also have important policy implications. They facilitate comparisons with the costs of other social ills, provide an indication of the relative importance of crime as a social problem, and give guidance for the general allocation of resources. Such estimates also help identify the relative harm for specific types of crime and indicate where policies and resources are best directed. Accurate estimates of the costs of criminal violence are also important for making cost-benefit assessments of different policy options. They facilitate assessments of the savings that might accrue from particular crime-prevention strategies. These can be compared to the costs of implementing particular strategies to assess the overall benefit of different policy options. Ultimately, accurate estimates of the costs of crime are central to understanding crime as a social problem and to the formulation and implementation of crime-related social policy.

While it is difficult enough to enumerate the many consequences of crime, it is considerably more difficult to quantify and monetize these consequences to estimate costs. While some costs are relatively easy to estimate, others are virtually impossible. Still, an extensive and growing body of research in criminology and economics has attempted to place dollar values on the pain, suffering, and loss that accompany criminal activity. This entry provides a conceptual framework for estimating costs of crime and examines both costs of crime and vulnerability to such costs.

The following annual figures estimating the various costs of crime in the mid-1990s come from the National Institute of Justice and a study by David A. Anderson called "The Aggregate Burden of Crime." The study was published in the October 1999 issue of the Journal of Law and Economics. Crime costs are based on approximately 49 million annual crimes and attempted crimes in the United States.

$105 billion each year in medical bills and lost earnings; $450 billion when including pain and suffering and lost quality of life

$400 billion to operate corrections facilities

$130 billion for crime prevention and loss of potential productivity of criminals and inmates

$1 trillion when including the cost of the criminal justice systems, as well as private individuals and companies taking security measures

$603 billion lost to the economy from fraud and unpaid taxes

$500 million of money or valuables taken in robberies

$45 billion paid by insurance programs to crime victims

$8 billion paid to victims by U.S. government annually for restorative and emergency services

3 percent of all medical expenses in the nation is related to violent crimes

1 percent of annual U.S. earnings is equal to wage losses from violent crime

10 to 20 percent of mental healthcare costs are attributed to crime

$54,000 is the average cost of each arson incident; $31,000 for each assault

$25,000 to $30,000 is the annual cost of an inmate in prison

4 out of 5 gunshot victims end up on public assistance and uninsured, costing the government $4.5 billion annually
